The CPC approved for public consultation a new draft decision for block exemption of certain categories of agreements, decisions and concerted practices from the prohibition contained in Art. 15, para. 1 of the Law on Protection of Competition

The Commission for the Protection of Competition issued a new draft of a decision for block exemption from the prohibition contained in Ar. 15, para. 1 of the LPC of certain categories agreements, decisions and concerted practices.

The successor to Decision No. 55/20.01.2011 replicates the formerly adopted approach of explicit reference to the scope and the conditions for block exemption envisaged in the respective EU regulations. By that, the national rules for block exemption are made reciprocal to those governed by the European regulations for block exemption of certain categories agreements, decisions and concerted practices from the prohibition of Art. 101 TFEU.

The purpose of the new CPC decision is to settle the issue of block exemption of certain categories agreements, decisions and concerted practices which contribute to improving the production or distribution of goods or to promoting technical or economic progress, while allowing consumers a fair share of the resulting benefit, which do not have a cross-border influence, in a manner equivalent to the one enshrined in the European legal framework.
