The Commission on Protection of Competition (CPC) has addressed allegations for committed infringement of Art. 24, par. 1 of the Law on protection of competition (LPC) to Agria Group Holding JSC
The Commission on Protection of Competition has adopted a Statement of objections No. 905/01.08.2019 for an alleged infringement by Agria Group Holding JSC, constituting an implemented concentration without prior notification to the CPC.
By Decision No. 898/08.08.2018, the Commission initiated proceedings on its own initiative for a possible infringement concerning the acquisition of sole control over Kehlibar EOOD by Agria Group Holding JSC.
Based on the collected information and evidence, the Commission established an infringement of Article 24, para. 1 of the LPC by Agria Group Holding JSC, which is subject to pecuniary sanction under Art. 100, para. 1, item 2 of the LPC. After assessment of the competitive effect of the transaction on the relevant markets, the Commission comes to the conclusion that the transaction would have been unconditionally authorized if notified in accordance with the relevant legal procedure.
Agria Group Holding JSC has the right to submit its written objections within 30 (thirty) days after receiving the Statement of objections, as well as to be heard by the Commission pursuant to Art. 76 of the LPC.
