The Commission on Protection of Competition (CPC) imposes a pecuniary sanction on Agria Group Holding JSC

With Decision No1212/07.11.2019 the Commission on Protection of Competition found that Agria Group Holding JSC had implemented a concentration without mandatory prior notification to the CPC under Art. 24, par. 1 of the LPC.

The Commission has imposed a pecuniary sanction under Art. 100, para. 1, item 2 of the LPC in an amount of BGN 65 000 depending on the gravity of the infringement, but not less than the fee which would have been paid if the CPC had been informed. In this case the sanction is determined, in order to achieve deterrence.

According to Art. 64, par. 1 of the LPC, the Decision may be appealed before the Sofia Administrative Court. The deadline for submitting an appeal is 14 days, which for the parties tothe proceedings start as of the moment they are notified of the decision, and for third parties – from the moment the decision is published on the electronic register of the Commission.
